STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to driveway construction permit fees.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Driveway Construction Permit Fees. Amend RSA 236:13 by inserting after paragraph III the following new paragraph:

III-a. The department of transportation shall charge a fee to cover costs expended to perform engineering reviews and construction inspections under subparagraphs III(a) and (b) associated with the issuance of driveway permits. The fee for work performed by department technical and engineering personnel shall be $65 per hour. The fee for work performed by consultants engaged by the department to assist with this work shall be the actual costs charged by the consultant.

2 New Paragraph; Driveway Construction Permit Fees. Amend RSA 21-L:12 by inserting after paragraph X the following new paragraph:

X-a. Fees for driveway construction permits, as authorized by RSA 236:13, III-a.

3 Effective Date. This act shall take effect 60 days after its passage.

SB 104-FN-A - FISCAL NOTE

AN ACT relative to driveway construction permit fees.

FISCAL IMPACT:

The Department of Transportation states this bill will increase state highway fund revenue and decrease state highway fund expenditures by $614,250 in FY 2010 and each year thereafter. This bill will have no fiscal impact on county and local revenue or expenditures.

METHODOLOGY:

The Department of Transportation states this bill will permit the Department to charge fees to cover the costs associated with the issuance of major development driveway permits. The Department states an average of 30 driveway applications per year are for major developments on the State highway system that require a traffic impact study as part of the driveway permitting process. The Department reviews these traffic impact studies and proposed construction plans, as well as, conducting construction inspection of the highway improvements for each of the major developments. These reviews and inspections take approximately 315 staff hours per application, for a total of 9,450 staff hours per year, to complete. Using an hourly rate of $65 per hour, (including salary, benefits, and overhead), state highway fund expenditures will increase by $614,250 in FY 2010 and each year thereafter. Since this bill will allow the Department to charge fees to cover these costs, state highway fund revenue will also increase by $614,250 in FY 2010 and each year thereafter.
