STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT establishing a commission to develop a legislative plan to meet the needs of certain adults with developmental disabilities.

Be it Enacted by the Senate and House of Representatives in General Court convened:

255:1 Commission Established. There is established a commission that shall develop a strategic, legislative plan to meet the needs of adults with developmental disabilities or acquired brain disorders who present a moderate to high degree of risk to community safety.

255:2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) One member of the senate, appointed by the president of the senate.

(b) Two members of the house of representatives, one of whom shall serve on the house health, human services and elderly affairs committee and one of whom shall serve on the house finance committee, appointed by the speaker of the house of representatives.

(c) The commissioner of the department of health and human services, or designee.

(d) The bureau administrator of the bureau of behavioral health, department of health and human services, or designee.

(e) The bureau chief of the bureau of developmental services, department of health and human services, or designee.

(f) The commissioner of the department of corrections, or designee.

(g) The attorney general, or designee.

(h) One member of the Community Support Network, Inc., appointed by the network.

(i) One member of the Private Provider Network, appointed by the network.

(j) One member of the New Hampshire Coalition Against Domestic and Sexual Violence, appointed by the coalition.

(k) One member of the Brain Injury Association of New Hampshire, appointed by the association.

(l) One member of the Disabilities Rights Center, appointed by the center.

(m) One member of the Institute on Disability, appointed by the institute.

(n) A representative of the governor’s commission on disability, appointed by the commission.

(o) A judge, appointed by the chief justice of the New Hampshire supreme court.

(p) A representative of the New Hampshire Association of Counties, appointed by the association.

(q) A member of the New Hampshire Psychological Association, appointed by the association.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

255:3 Duties.

I. The commission shall:

(a) Make recommendations on developing a permanent state forensics team.

(b) Develop legislation that creates a delivery system for a continuum of services for this population.

(c) Develop an assessment tool for use by the appropriate professional in determining the need for services and the level of services required.

(d) Utilize data from reports and studies already completed to address these issues.

II. The commission may consult with any individual or organization with information or expertise relevant to the commission’s objectives.

255:4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Five members of the commission shall constitute a quorum.

255:5 Report. The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2009.

255:6 Effective Date. This act shall take effect upon its passage.
