STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT establishing a commission to study the creation of an uncompensated care fund to provide payments to certain health care providers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study the creation of an uncompensated care fund to provide payments to health care providers who provide a disproportionate share of care to the state’s uninsured population.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Two members of the senate, appointed by the president of the senate.

(b) Two members of the house of representatives, appointed by the speaker of the house of representatives.

(c) The commissioner of the department of health and human services, or designee.

(d) The commissioner of the department of insurance, or designee.

(e) A representative of the New Hampshire Hospital Association, appointed by the association.

(f) A representative of the New Hampshire Medical Society, appointed by the society.

(g) A representative of the Endowment for Health, appointed by such organization.

(h) A representative of a private for profit insurance carrier doing business in New Hampshire, appointed by the governor.

(i) A representative of a private nonprofit insurance carrier doing business in New Hampshire, appointed by the governor.

(j) A director of a community mental health center, appointed by the governor.

(k) A director of a community health center, appointed by the governor.

(l) A public member who is uninsured or underinsured, appointed by the governor.

(m) A representative of the New Hampshire Citizen’s Health Initiative, appointed by the governor.

(n) A representative of the Bi-State Primary Care Association, appointed by the association.

(o) The attorney general, or designee.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties. The commission shall study the creation of an uncompensated care fund to provide payments to health care providers who provide a disproportionate share of care to the state’s uninsured population.

4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Seven members of the commission shall constitute a quorum.

5 Report. The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2009.

6 Effective Date. This act shall take effect upon its passage.
