STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nine
AN ACT eliminating the financial ceiling on design build contracting for transportation projects.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 State Transportation Projects. Amend RSA 228:4, I(c) to read as follows:
(c) [Statewide transportation improvement program projects with a cost not to exceed $5,000,000 may be] Transportation projects developed and constructed utilizing the design build concept based on a request for proposal[,]. Such projects may be developed and constructed provided that selection is based on an objective standard and measurable criteria for evaluation of the proposals. The commissioner shall report the results of any statewide transportation improvement program project using the design build concept to the capital budget overview committee within 90 days after the completion of the project.
2 Effective Date. This act shall take effect 60 days after its passage.

SB 69-FN - FISCAL NOTE
AN ACT eliminating the financial ceiling on design build contracting for transportation projects.
FISCAL IMPACT:
The Department of Transportation states this bill will have an indeterminable impact on state expenditures in FY 2010 and each year thereafter. This bill has no fiscal impact on state, county, and local revenues or county and local expenditures.
METHODOLOGY:
The Department of Transportation states this bill permits certain transportation projects to utilize the design build concept based on a request for proposal and excludes such projects from the financial contract ceiling. The Department has no information to determine whether this bill will increase or decrease the cost of construction projects. The scope of work for each project is unique and involves its own individual complexities. Typically design/build projects result in shorter design and construction durations and allow for increased flexibility and creativity in the design and construction process. Additionally, there may be some inflationary savings to accelerating construction over conventional means.
