STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT establishing a commission to study the feasibility of regional transit.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study the feasibility of regional transit.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) One member of the senate transportation and interstate cooperation committee, appointed by the president of the senate.

(b) One member of the house transportation committee, appointed by the speaker of the house of representatives.

(c) One representative of the southern New Hampshire planning commission, appointed by that organization.

(d) One representative of the central New Hampshire regional planning Commission, appointed by that organization.

(e) One representative of the Rockingham planning commission, appointed by that organization.

(f) The commissioner of the department of transportation, or designee.

(g) One representative of the Manchester Transit Authority, appointed by that organization.

(h) One representative of the community action program in Concord, appointed by the board of directors of that organization.

(i) One representative of the Derry-Salem cooperative alliance for regional transportation, appointed by the chairperson of the board of directors of that organization.

(j) One representative of the Nashua Transit System, appointed by the mayor of the city of Nashua.

(k) The mayor of the city of Manchester, or designee.

(l) The mayor of the city of Nashua, or designee.

(m) The mayor of the city of Concord, or designee.

(n) One representative of Boston Express, appointed by the president of that company.

(o) The commissioner of the department of health and human services, or designee.

II. Members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties. The commission shall:

I. Examine the feasibility of expanding the scope of the transit services presently provided by the Manchester Transit Authority.

II. Examine how existing services provided by the Manchester Transit Authority and other organizations can be coordinated more effectively and used more efficiently through a transit brokerage concept.

III. Review literature documenting efforts in other areas to develop and coordinate regional transit and address the need for improved regional mobility and accessibility.

IV. Facilitate an understanding of the changes in development and travel patterns that have resulted in the need to provide improved and better coordinated transit services on a regional scale.

V. Collect information on different organization models to provide and coordinate regional transit services.

VI. Identify individual organizational models with focus on the existing models in New Hampshire, including the Cooperative Alliance for Seacoast Transportation, the Greater Derry Greater Salem Regional Transportation Council, and the Manchester Transit Authority.

VII. Identify how regional transit has been developed in other areas.

VIII. Assemble materials describing the advantages and disadvantages of different organizational models for providing and coordinating regional transit.

4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Nine members of the commission shall constitute a quorum.

5 Report. The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2009.

6 Effective Date. This act shall take effect upon its passage.
