STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to the compensation of game operators.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Compensation of Game Operators. Amend RSA 287-E:7, II to read as follows:

II. No compensation shall be paid to operators of a bingo game. Compensation shall include, but is not necessarily limited to, money or any other thing of value. Operators of bingo games may be reimbursed for their out-of-pocket expenses in an amount not to exceed [$25] $60 per game date, provided that such expenses are itemized and submitted in writing to the charitable organization.

2 Repeal. The following are repealed:

I. 2007, 280:2, relative to reducing the maximum value of prizes for certain games.

II. 2007, 280:5, I, relative to the effective date of 2007, 280:2.

III. RSA 287-A:9, relative to the capacity requirement for raffles held at bingo games.

3 Effective Date.

I. Section 2 of this act shall take effect June 30, 2009.

II. The remainder of this act shall take effect upon its passage.

SB 79 FISCAL NOTE

AN ACT relative to the compensation of game operators.

FISCAL IMPACT:

      The Racing and Charitable Gaming Commission states this bill, as amended by the Senate (Amendment #2009-0285s), may increase education trust fund revenue by an indeterminable amount in FY 2010 and each year thereafter. There is no fiscal impact on county and local revenue or state, county, and local expenditures.

METHODOLOGY:

    The Racing and Charitable Gaming states this bill raises the limit for which game operators may be reimbursed for out-of-pocket expenses, repeals the prospective reduction of the maximum value of prizes for certain games, and repeals the capacity requirement for raffles held at bingo games. The Commission states the continuation of the prize limit of $4,000 and allowing halls with a capacity of more than 300 persons to hold raffles may attract additional players that might purchase winner take all games thus increasing the tax collected pursuant to 287-E:8. Per RSA 284:21-j, revenue would be deposited into a special fund and any balance left in such fund after expenses are paid will be deposited into the education trust fund.
