AN ACT relative to recommendations of marital masters.

ANALYSIS

This bill removes that requirement that recommendations of marital masters be signed by a judge when the recommendation is upon an uncontested, nondispositive motion or where the parties consent in advance and in writing to the entry of final judgment by the marital master. The bill also establishes that any recommendation of a marital master not signed by a judge may be the subject of an appeal to the supreme court.

This bill was requested by the supreme court.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to recommendations of marital masters.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Judicial Branch Family Division; Recommendations of Marital Masters. Amend RSA 490-D:9 to read as follows:

490-D:9 Recommendations of Marital Masters. All recommendations of marital masters shall be signed by a judge, except where the recommendation is upon an uncontested, nondispositive motion or where the parties consent in advance and in writing to the entry of final judgment by the marital master. Any recommendation of a marital master not signed by a judge pursuant to this section may be the subject of an appeal to the supreme court, in accordance with the rules of the supreme court.

2 Application During Implementation. During the implementation of the judicial branch family division statewide, RSA 490-D:9 shall apply to recommendations of marital masters in both the superior court and the judicial branch family division.

3 Effective Date. This act shall take effect January 1, 2010.
