AN ACT relative to the duties of a moderator and a municipality before, during, and after an election.

ANALYSIS

This bill limits the authority of a town moderator before, during, and after an election to the interior of the polling place and requires municipalities to enact legislation, after a public hearing, to control certain conditions near the polling place on election day.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to the duties of a moderator and a municipality before, during, and after an election.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Moderator to Oversee Voting. Amend RSA 659:9 to read as follows:

659:9 Moderator to Oversee Voting in Polling Place. It shall be the duty of the moderator to secure the observance of the provisions of the following sections relating to the conduct of voting occurring inside the polling place before, during, and after the election. Except as provided in RSA 659:43, II, the municipality shall, after a public hearing, enact legislation to control traffic flow, parking, and the placement of signage at the polling place on election day.

2 Effective Date. This act shall take effect 60 days after its passage.
