STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT establishing a committee to study state regulations governing installation of boilers, pressure vessels, and related high performance HVAC equipment.

Be it Enacted by the Senate and House of Representatives in General Court convened:

251:1 Committee Established. There is established a committee to study state regulations governing installation of boilers, pressure vessels, and related high performance heating, ventilating, and air conditioning (HVAC) equipment.

251:2 Membership and Compensation.

I. The members of the committee shall be as follows:

(a) One member of the senate, appointed by the president of the senate.

(b) Four members of the house of representatives, 2 of whom shall be members of the science, technology and energy committee and 2 of whom shall be members of the executive departments and administration committee, appointed by the speaker of the house of representatives.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

251:3 Duties. The committee shall:

I. Study existing boiler and pressure vessel regulations and make recommendations on how to modernize these regulations so that they encourage innovation and adoption of high efficiency, low emission heating, and combined heat and power technology, while ensuring continued emphasis on public health and safety.

II. Study and make recommendations on related state statutes and rules governing installation of high performance HVAC technology to ensure that these rules do not impose an undue constraint on deployment of new technology including technology available outside the United States.

III. Evaluate and make recommendations on related state statutes and regulations determined to be relevant, at the discretion of the committee.

IV. Analyze the impact high efficiency boilers and combined heat and power systems may have on achieving National Ambient Air Quality Standards (NAAQS).

251:4 Chairperson; Quorum. The members of the committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Three members of the committee shall constitute a quorum.

251:5 Report. The committee shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2009.

251:6 Effective Date. This act shall take effect upon its passage.
