AN ACT relative to criminal record checks by health facilities.

ANALYSIS

This bill declares that a criminal background check shall not be required if a health facility obtains a comparable criminal background check from a private vendor or other source approved by the commissioner of the department of health and human services under rules adopted under RSA 541-A.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to criminal record checks by health facilities.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Health Care Facilities; Criminal Background Checks. Amend RSA 151:2-d by inserting after paragraph VI the following new paragraph:

VII. A criminal background check by the division of state police shall not be required if a facility obtains a comparable criminal background check from a private vendor or other source approved by the commissioner of health and human services, under rules adopted pursuant to RSA 541-A, provided all other requirements of this section are met.

2 New Paragraph; Rulemaking Added. Amend RSA 151:9 by inserting after paragraph IX the following new paragraph:

X. The commissioner of the department of health and human services shall adopt rules under RSA 541-A establishing criteria for approval of private vendors or other sources providing criminal background checks to health facilities pursuant to RSA 151:2-d, VII.

3 Home Health Care Providers; Rulemaking. Amend the introductory paragraph of RSA 151:9-a to read as follows:

The commissioner of the department of health and human services shall adopt rules under RSA 541-A, relative to the licensing of home health care providers that are separate from rules relative to other health facilities. Such rules shall be subject to the requirements of RSA 151:9, II-V and RSA 151:9, IX and X and shall include the following:

4 New Paragraph; Home Health Providers; Rulemaking Added. Amend RSA 151:9-a by inserting after paragraph XI the following new paragraph:

XII. Establishing criteria for approval of private vendors or other sources providing criminal background checks to health facilities pursuant to RSA 151:2-d, VII.

5 Effective Date. This act shall take effect upon its passage.
