STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to state licensure of hawkers and peddlers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Hawkers and Peddlers; Exception Added. Amend RSA 320:3 by inserting after paragraph VI the following new paragraph:

VII. Any person engaged in hawking or peddling conducting business in a town for less than 14 days in a year.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 1229-FN - FISCAL NOTE

AN ACT relative to state licensure of hawkers and peddlers.

FISCAL IMPACT:

      The Department of State states this bill will decrease state revenue by an indeterminable amount in FY 2010 and each year thereafter. There will be no fiscal impact on county and local revenue or on state, county, and local expenditures.

METHODOLOGY:

    The Department of State states this bill exempts hawkers and peddlers doing temporary business in a town from the requirements of state licensure. The Department states it issued 397 licenses in FY 2007 generating revenue of $19,850, 411 licenses in FY 2008 generating revenue of $20,550, and 476 licenses in FY 2009 generating revenue of $23,805. Based on available data, the Department cannot estimate how many of the annual licenses would be subject to the proposed exemption; therefore it cannot estimate an actual amount by which revenue would decline.

    The New Hampshire Municipal Association states it could not identify a fiscal impact to the municipalities as a result of the proposed legislation.
