STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Ten
AN ACT relative to a certain insurance rulemaking exemption.
Be it Enacted by the Senate and House of Representatives in General Court convened:
93:1 Insurance; Rulemaking Exemption. Amend RSA 541-A:21, VI to read as follows:
VI. Rules adopted under title XXXVII, relative to insurance regulation, shall be exempt from RSA 541-A:7 and RSA 541-A:8 and shall permit the use of terminology allowing for discretionary authority by the commissioner [if] when:
(a) The wording is consistent with the language of corresponding National Association of Insurance Commissioners [models].
(b) The rule relates to technical instructions concerning the implementation of electronic or computerized programs or systems.
(c) The rule implements a federal benefit or program that requires the adoption of uniform language.
93:2 Effective Date. This act shall take effect 60 days after its passage.
