AN ACT relative to insurance coverage in tort cases.

ANALYSIS

This bill requires an insurance carrier to disclose the limits of the liability insurance policy to a person or the person’s legal representative upon request in a tort case. Current law allows the superior court in its discretion to order such disclosure only to opposing counsel.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to insurance coverage in tort cases.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Insurance Coverage in Tort Cases. RSA 498:2-a is repealed and reenacted to read as follows:

498:2-a Insurance Coverage in Tort Cases. On or before 60 days from the date any request by a person or the person’s legal representative claiming against an insurance carrier responsible, or alleged to be responsible, for the defense of any claim by the terms of the carrier’s policy, the carrier shall disclose to the requestor for purpose of encouraging settlement negotiations, the policy limits of the liability insurance policy which is the subject of such request.

2 Effective Date. This act shall take effect January 1, 2011.
