STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT authorizing enhanced compensatory damages for injury or death caused by operation of a motor vehicle after consumption of alcohol or a controlled drug.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Private Actions. Amend RSA 265-A by inserting after section 18 the following new section:

265-A:18-a Private Actions. In an action for damages, where the defendant caused injury or death by the operation of a motor vehicle in violation of the provisions of RSA 265-A after consuming or using alcohol or any controlled drug, knowing that he or she would thereafter operate the motor vehicle, the plaintiff, in addition to compensatory damages, may recover enhanced compensatory damages.

2 Effective Date. This act shall take effect January 1, 2011.
