AN ACT relative to setback requirements on private rights-of-way.

ANALYSIS

This bill provides that a private right-of-way of undetermined width that forms a boundary line for one or more properties shall be deemed to be the width required by the municipality for town roads solely for the purpose of setback requirements under the local land use ordinances.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to setback requirements on private rights-of-way.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Private Rights-of-Way. Amend RSA 672 by inserting after section 14 the following new subdivision:

Setback Requirements; Private Rights-of-Way

672:15 Setback Requirements; Private Rights-of-Way. When a private right-of-way of undetermined width forms a boundary line for one or more properties, the width of the right-of-way shall be deemed to be the same width as that required by the municipality for a town road, solely for the purpose of designated setback requirements under the local land use ordinances for structures, driveways, parking areas, and above and below ground utility tanks.

2 Effective Date. This act shall take effect 60 days after its passage.
