AN ACT relative to licensure of home inspectors by the board of home inspectors.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to licensure of home inspectors by the board of home inspectors.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Licenses; Grandfathering Provision. Amend RSA 310-A:190, II to read as follows:

II. A person who was actively engaged in the business of home inspection in this state as a means of his or her livelihood for at least [12 months] 5 years preceding the effective date of this subdivision shall be eligible for licensure by the board without completion of the requirements of subparagraph I(a) through I(d). An applicant under this paragraph shall be issued a license [by] upon paying an initial fee and upon providing evidence satisfactory to the board of [the knowledge and experience equivalent to the requirements of subparagraph I(a). All applicants shall meet the requirements of subparagraphs I(b) through (e), pay an initial fee, and fulfill all other license application requirements] proof of liability insurance and meeting the requirements of this paragraph. The board may, at its discretion, refuse to license an applicant under this paragraph who was the subject of a complaint filed with the attorney general’s consumer protection and antitrust bureau during such period.

2 License Applications; Grandfathering Exception. Amend the introductory paragraph of RSA 310-A:191, II to read as follows:

II. Applicants who are not subject to the grandfathering provisions of RSA 310-A:190, II shall include the following:

3 License Applications. Amend RSA 310-A:191, II(e) to read as follows:

(e) [Any other attachments as] Copies of the applicants’ written inspection reports, if required by the board.

4 Required Licensure; Date Changed. Amend RSA 310-A:189 to read as follows:

310-A:189 License Required. Beginning [January 1, 2010] October 1, 2010, no person shall practice as a home inspector or conduct home inspections in this state without a home inspector's license issued by the board under this subdivision.

5 Violations; Date Changed. Amend RSA 310-A:199, V to read as follows:

V. Beginning [January 1, 2010] October 1, 2010, practice home inspections or to offer, advertise, or hold oneself out to the public as being in the practice of home inspection in this state without a license; or

6 Application; Grandfathering Provisions.

I. The changes made by this act relative to licensure of home inspectors by the board of home inspectors shall not apply to any person granted a license by the board prior to the effective date of this act.

II. Any person who is eligible for licensure pursuant to the grandfathering provisions in RSA 310-A:190, II, as amended by this act, may apply for licensure according to the terms of RSA 310-A:182 through 310-A:201, as amended by this act, whether or not the person had previously applied or otherwise been refused licensure by the board of home inspectors.

7 Effective Date. This act shall take effect upon its passage.
