AN ACT relative to extending the days for recreational taking of clams following an emergency closing.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Fish and Game; Taking of Bivalves; Closing; Extension. Amend RSA 211:63-a to read as follows:
211:63-a Emergency Closing.
I. Any rules adopted under the authority of RSA 211:62 may be suspended and the taking of bivalves may be prohibited in any area when the department of environmental services shall determine that accidental pollution exists in the area. The emergency closing shall be ordered by the executive director without a hearing. The executive director shall, for each day of such closing of a clamming area, extend the number of days in the calendar year or add additional days during the current season, in which a person licensed under RSA 211:64-b may take clams for recreational purposes.
II. The executive director after a hearing shall have authority to order a partial closing of clam, oyster, and other bivalve areas for the purpose of management of the areas by rotation. When such management closing is ordered the order shall be effective immediately without a waiting period.
2 Effective Date. This act shall take effect 60 days after its passage.
