STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Ten
AN ACT relative to pool safety.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; Swimming Pools. Amend RSA 31 by inserting after section 133 the following new subdivision:
Swimming Pools
31:134 Swimming Pools.
I. No municipality shall issue a permit for a private swimming pool having the capability of accommodating a depth of at least 18 inches of water unless such pool is completely surrounded by a non-porous fence or wall not less than 4 feet in height, equipped with a locking device and a motion sensor alarm system.
II. No owner of a private swimming pool shall permit use of such pool until such permit is granted.
31:135 Penalty for Non-Compliance. Any person who fails to comply with RSA 31:134, II shall pay a penalty of $100 per day for each day of non-compliance.
2 New Subdivision; Swimming Pools. Amend RSA 47 by inserting after section 28 the following new subdivision:
47:29 Swimming Pools.
I.
