HOUSE BILL 1370
AN ACT requiring independent medical examination practitioners to file a report with the insurance department.

This bill requires health care providers performing 10 or more independent examinations per year to file a report with the insurance department.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Ten
AN ACT requiring independent medical examination practitioners to file a report with the insurance department.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Workers' Compensation; Medical Examinations. Amend RSA 281-A:38 by inserting after paragraph II the following new paragraph:
III. Any health care provider who performs 10 or more independent medical examinations under this chapter shall file an annual report with the insurance commissioner containing the following information:
(a) The person or entity who hired the provider.
(b) How much the provider was paid for the examination.
(c) Whether the examination was requested by the company or the insurance carrier.
(d) Whether the finding was for the claimant or the insurance carrier or company on the causation of injury.
(e) Whether the finding was for the claimant or the insurance carrier on the causation of medical treatment.
(f) Whether the examination was requested for workers’ compensation payments or litigation.
2 Effective Date. This act shall take effect January 1, 2011.
