AN ACT requiring notice of the decision against rehiring be provided to educational support personnel.

This bill requires any person who is part of a school district’s educational support personnel to receive notice and a hearing if such person is not to be rehired.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT requiring notice of the decision against rehiring be provided to educational support personnel.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Notice for Educational Support Personnel. Amend RSA 189 by inserting after section 14-g the following new section:

189:14-h Notice to Educational Support Personnel.

I. All educational support personnel who have been employed for one or more years in the same school district shall be notified in writing on or before April 15 or within 15 days of the adoption of the district budget by the legislative body, whichever is later, if such person is not to be rehired, provided that no notification shall occur later than the Friday following the second Tuesday in May.

II. Educational support personnel shall be eligible to receive unemployment compensation benefits as of the end of the school year in which the decision against rehiring is made, or earlier as may be provided by law.

III. In this section, “educational support personnel” means teacher’s aides, food service staff, custodial and maintenance staff, security staff, health care staff, library, computer, and audio/visual staff, clerical and administrative staff, and transportation staff employed by a school district.

2 Effective Date. This act shall take effect 60 days after its passage.
