AN ACT requiring the department of health and human services to provide a legislative report on Katie Beckett, the Medicaid program for home care for children with severe disabilities.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT requiring the department of health and human services to provide a legislative report on Katie Beckett, the Medicaid program for home care for children with severe disabilities.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Home Care for Children with Severe Disabilities; Legislative Report.

I. The department of health and human services shall provide a legislative report on the administration of the Katie Beckett Program, a Medicaid waiver program providing home care for children with severe disabilities, including:

(a) A summary of the eligibility criteria for program participation and the number of children participating in the program.

(b) A summary of the type of services and supports available to children participating in the program, including the delivery mechanism for such services, the ability of parents to arrange and purchase necessary supports and related services, and the availability of respite or day care services for children who have been identified as medically fragile or chronically ill.

(c) A comparison of the type and availability of services under Katie Beckett with those available to children under the in home support waiver for children with developmental disabilities and the New Hampshire community passport program.

(d) A determination of whether an amendment to the Medicaid waiver establishing home care for children with severe disabilities is appropriate or possible, the procedure and timeline for submitting such an amendment, and if an amendment is not required, the basis for that decision.

(e) Any recommendations or relevant findings regarding program administration.

II. The commissioner of the department of health and human services shall submit the report required under paragraph I to the chair of the house children and family law committee, the chair of the senate health and human services committee, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2010.

2 Effective Date. This act shall take effect upon its passage.
