STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT establishing a commission to oversee creation of a monument to acknowledge and commemorate persons enslaved in New Hampshire from 1645 to 1840.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to create a monument to acknowledge and commemorate persons enslaved in New Hampshire from 1645 to 1840.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Three members of the senate, appointed by the president of the senate.

(c) One member from the department of cultural resources, appointed by the department.

(d) One member from the New Hampshire state council on the arts, appointed by the state council.

(e) One member from the New Hampshire historical society, appointed by the society.

(f) One member from the university of New Hampshire, appointed by the president of the university.

(g) One member of African American heritage, appointed by the governor.

(h) One member of Native American heritage, appointed by the governor.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties. The commission shall:

I. Supervise volunteer research to determine the names and numbers of people enslaved in New Hampshire from 1645 to 1840.

II. Solicit and recommend a monument design and location on or near the state house complex.

III. Designate a non-profit entity to act as fiscal agent for collection and expenditure of private funds raised for the creation of the monument.

IV. Solicit input from state social and religious organizations, such as the Portsmouth Black Heritage Trail, the Harriet Wilson Project, and the National Association for the Advance of Colored People.

4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Six members of the commission shall constitute a quorum.

5 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2010.

6 Effective Date. This act shall take effect upon its passage.
