This bill provides an exception from the wiretapping and eavesdropping statute for audio recordings made in a public building, provided notice of such recording is posted at the public building.

In the Year of Our Lord Two Thousand Ten
AN ACT relative to recording oral communications.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subparagraph; Wiretapping and Eavesdropping; Exceptions. Amend RSA 570-A:2, II by inserting after subparagraph (l) the following new subparagraph:
(m) A person to make an audio recording of another person in a public building, provided that a sign at least 2 square feet in size containing large, easily readable lettering giving notice that audio recording is occurring shall be conspicuously posted and easily visible upon entrance and exit from the public building. The sign shall contain no information other than the notification of audio recording. In this subparagraph, “public building” means any building available for any person, group, or organization, which may include retail business establishments when they are not open to the public. A public building shall not be construed to mean a private residence.
2 Effective Date. This act shall take effect 60 days after its passage.
