STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT establishing a state aeronautical fund.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subparagraph; General Fund Exceptions. Amend RSA 6:12, I(b) by inserting after subparagraph (299) the following new subparagraph:

(300) Moneys deposited in the state aeronautical fund pursuant to RSA 422:35.

2 Aeronautics; Disposition of Revenue. Amend RSA 422:35 and 422:36 to read as follows:

422:35 Disposition of Revenue.

I. All fees, fines, or other income received under the provisions of this chapter shall be paid by the department to the state treasurer, except as provided in RSA 422:36.

II. There is hereby established the state aeronautical fund. All airways toll revenue paid over by the director of the division of motor vehicles under RSA 422:34 shall be deposited in the fund. The commissioner is authorized to accept gifts to further the purposes of this chapter and shall deposit them in the fund. The moneys in the fund shall be nonlapsing and shall be continually appropriated to the department for the purpose of funding maintenance of airports within the state that are open for public use and planning and implementing capital improvements to such airports.

III. The director shall annually report on the state aeronautical fund to standing committees of the senate and the house of representatives with jurisdiction over taxation and jurisdiction over aeronautical projects. The format of the report shall be as follows:

(a) Total moneys received from each revenue source.

(b) List of projects funded and expenditure totals for each.

(c) Moneys remaining in the fund.

422:36 Airways Toll Moneys; Aircraft Operating Fee Revenues.

I. A portion of moneys derived from the airways toll, available for the establishment and maintenance of air navigation facilities, may be paid over directly to a city or town which has established an aeronautical fund in accordance with the provisions of RSA 423:6, [7] RSA 423:7, and [8] RSA 423:8.

II. Disbursements of revenue from the aircraft operating fee shall be made by the department after collection of such fees provided that 1/4 of aircraft operating fee revenues originating at a publicly or privately owned airport shall be available for public use and shall, upon application, be paid over to the aeronautical fund established for that airport and shall be used for aeronautical purposes.

3 Effective Date. This act shall take effect July 1, 2011.

HB 1506 FISCAL NOTE

AN ACT establishing a state aeronautical fund.

FISCAL IMPACT:

      The Department of Transportation states this bill, as amended by the House (Amendment #2010-0500h), will decrease state general fund revenue and increase state restricted revenue and expenditures by $300,300 in FY 2012, $330,330 in FY 2013 and $363,363 in FY 2014. This bill will have no fiscal impact on county and local revenue or expenditures.

METHODOLOGY:

    The Department of Transportation states this bill establishes a state aeronautical fund and places revenue from airways toll (aviation fuel tax) in the fund. The Department states the total airways toll collected in FY 2009 was $273,000. The Department expects that the airways toll revenue will remain flat for the remainder of this biennium (FY 2010-2011). Using the 2009 amount, $273,000 as the base figure for calculating future years, the Department estimated that the collected airway toll (aviation gas tax) revenue will increase by 10% each year in FY 2012 through FY 2014. Therefore, state general fund revenue is projected to decrease and state restricted revenue and expenditures projected to increase by $300,300 in FY 2012, $330,330 in FY 2013 and $363,363 in FY 2014.

    The Department further states that since this bill is effective July 1, 2011 (the beginning of the next biennium), the $680,000 appropriated from the general fund for the current FY 2010-2011 biennium, to support the administrative functions of the Bureau of Aeronautics is not impacted. This bill will have no fiscal impact on county and local revenue and expenditures.
