AMENDED ANALYSIS

This bill requires the judicial branch to continue to operate the Claremont, Colebrook, Milford, and Keene District Courts in fiscal year 2011 provided that the communities utilizing the specific courts absorb the rental costs and non-personnel operating costs of such courts. The bill requires the judicial branch to fund court security screening costs for these 4 courts for fiscal year 2011 within their existing appropriations.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to funding the Claremont, Colebrook, Milford, and Keene District Courts in fiscal year 2011.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Operation and Funding of Certain District Courts. For the fiscal year ending June 30, 2011, the Colebrook District Court, the Keene District Court, the Claremont District Court, and the Milford District Court shall remain open and continue to operate if the communities utilizing the specific courts absorb the rental costs and non-personnel operating costs of such courts.

2 Cost Allocation Plan. The department of administrative services shall work with the communities utilizing the Colebrook District Court, the Keene District Court, the Claremont District Court, and the Milford District Court to determine an appropriate cost allocation plan for the affected communities that clearly demonstrates what rent and operating costs will be recovered by the department.

3 Funding of Court Security Screening Costs. For the fiscal year ending June 30, 2011, the judicial branch shall continue to fund the court security screening costs at the Colebrook District Court, the Keene District Court, the Claremont District Court, and the Milford District Court within their existing appropriations.

4 Effective Date. This act shall take effect July 1, 2010.

HB 1516 FISCAL NOTE

AN ACT relative to funding the Claremont, Colebrook, Milford, and Keene District Courts in fiscal year 2011.

FISCAL IMPACT:

      The Judicial Branch and Department of Administrative Services state this bill, as amended by the House (Amendment #2010-0470h), will increase state expenditures by an indeterminable amount in FY 2011. There is no fiscal impact on county and local expenditures or state, county and local revenue.

METHODOLOGY:

    The Judicial Branch and the Department of Administrative Services state this bill requires the Branch to continue to operate the Claremont, Colebrook, Milford and Keene district courts in FY 2011 and fund the operation of the courts within existing appropriations. The bill also allows the Department of Administrative Services to work with the municipalities leasing space for the Claremont, Colebrook, and Keene district courts to obtain written agreements to waive the state’s obligation for FY 2011 lease payments. The lease amounts for FY 2011 for each court is as follows:

    Claremont District Court

    The Branch states it will need to fund the lease payments for the four courts with existing appropriations, which involves the transfer of up to $199,869 to the Department of Administrative Services, Bureau of Court Facilities, who has responsibility for the leased court facilities. If the municipalities leasing space for the Claremont, Colebrook and Keene district courts agree to waive the FY 2011 lease payments, the Branch will still need to fund the Milford district court lease at a cost of $80,623. In addition, the Branch will need to fund the per diem court security costs for the four district courts at a cost of $65,000 (one court security officer at $65 per day * 250 days * 4 district courts) in FY 2011.
