HOUSE BILL 1527
AN ACT relative to exceptions from the definition of private postsecondary career schools.
This bill exempts schools or churches with tax-exempt status in the state and which only offer religious courses or programs from the definition of private postsecondary career school. The bill also authorizes the executive director of the postsecondary commission, in consultation with the postsecondary education commission, to adopt rules establishing a procedure for creating exceptions to the definition of “private postsecondary education commission.”

In the Year of Our Lord Two Thousand Ten
AN ACT relative to exceptions from the definition of private postsecondary career schools.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subparagraph; Regulation of Private Postsecondary Career Schools; Definitions. Amend RSA 188-D:19, II by inserting after subparagraph (n) the following new subparagraph:
(o) Schools or churches with tax-exempt status in the state and which offer only religious courses or programs.
2 Postsecondary Education Commission; Rulemaking Authority. Amend RSA 188-D:26 to read as follows:
188-D:26 Rulemaking Authority. The executive director in consultation with the postsecondary education commission shall adopt such rules, pursuant to RSA 541-A, as may be necessary in order to carry out the provisions of this subdivision, including such rules establishing a procedure for creating exclusions from the definition of “private postsecondary career school” under RSA 188-D:19, II.
3 Effective Date. This act shall take effect 60 days after its passage.
