ANALYSIS

This bill exempts registers of probate from performance reviews by the supreme court for purposes of receiving salary step increases. The bill also establishes that registers of probate may be removed and replaced solely in the same manner as elected members of the general court.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to registers of probate.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Registers of Probate; Salaries. Amend RSA 548:17 to read as follows:

548:17 Salaries. The annual salaries of the registers of probate shall be established by the supreme court in accordance with the compensation system established by the supreme court. Registers of probate shall be exempt from performance reviews by the supreme court. For purposes of receiving salary step increases, registers shall be treated as if they had received better than satisfactory performance reviews. The register shall set the salary of the deputy register and all nonjudicial court support staff being directly supervised by the register consistent with the personnel procedures and compensation system established by the supreme court.

2 New Section; Removal of Register of Probate. Amend RSA 548 by inserting after section 27 the following new section:

548:27-a Removal. A register of probate may be removed and replaced solely in the same manner and by the same means as elected members of the general court.

3 County Officers; Removal. Amend RSA 661:9, IV to read as follows:

IV. Any officer of a county, [including] except for the register of probate, may be removed by the superior court for official misconduct.

4 Effective Date. This act shall take effect 60 days after its passage.
