STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to gold star number plates.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Gold Star Number Plates. Amend RSA 261:87-c to read as follows:

261:87-c Gold Star Number Plates.

I. The department shall furnish one set of special number plates, designed by the director with the approval of the commissioner, for one motor vehicle owned by a [mother] parent, spouse, sibling, or child of a person killed while on duty in the United States armed forces. These gold star number plates shall be issued upon payment of a one time $30 fee to recover production and administrative costs which shall be in addition to other number plate fees and the regular registration fees. There shall be no number plate fees or one time production and administrative fees for gold star number plates issued to the mother of the person killed.

II. For purposes of this section, a motor vehicle is owned by a [mother] parent, spouse, sibling, or child of a person killed while on duty in the United States armed forces if the [mother] parent, spouse, sibling, or child of a person killed while on duty in the United States armed forces is the motor vehicle's owner under RSA 259:72, I, or if the legal ownership of the motor vehicle is held by a trust established by the [mother] parent, spouse, sibling, or child of a person killed while on duty in the United States armed forces and the [mother] parent, spouse, sibling, or child of a person killed while on duty in the United States armed forces has use of the motor vehicle or the motor vehicle is used for the transportation of the [mother] parent, spouse, sibling, or child of a person killed while on duty in the United States armed forces. The director shall establish the documentation required for a motor vehicle held in trust to be eligible for plates under this section. The director shall not issue more than one set of plates under this section to any trust. A trustee of the trust or the administrator of the estate may be fined up to $500 for failing to return within 60 days of the death of the [mother] parent, spouse, sibling, or child of a person killed while on duty in the United States armed forces any plates issued under this section for a motor vehicle held in trust.

2 Implementation. The director of the division of motor vehicles may modify as necessary and issue any gold star number plates in the possession of the department of safety on the effective date of this act to any person requesting a gold star number plate pursuant to RSA 261:87-c as amended by this act.

3 Effective Date. This act shall take effect 60 days after its passage.

HB 1559-FN - FISCAL NOTE

AN ACT relative to gold star number plates.

FISCAL IMPACT:

      The Department of Safety states this bill will have an indeterminable fiscal impact on state highway revenue and expenditures and local revenue in FY 2011 and each year thereafter. There is no fiscal impact on county and local expenditures or county revenue.

METHODOLOGY:

    The Department of Safety states this bill expands the eligible recipients of gold star number plates from mothers only, to parents, spouses, siblings, or children of a person killed while on duty in the US armed forces, and adds a one time $30 fee for these plates.

    The Department assumes implementation of this bill in FY 2011, and asserts that there will most likely be additional expenditures incurred for the manufacture of the gold star plates requested, but the cost will be less than $10,000 for the necessary sheathing, aluminum and mailing of the plates requested. The Department further states the issuance of this new plate type could potentially reduce revenue collected for the other types of personalized plates where fees are charged each year such as vanity and conservation plates, resulting in a negative impact on revenue collected. Based on this unknown effect, the Department states the fiscal impact on state highway revenue cannot be estimated.

    Any change in state highway fund revenue will have a fiscal impact on state highway fund expenditures and local revenue by 12% of the change in accordance with RSA 235:23, local highway aid apportionment.
