AN ACT relative to the salaries of certain unclassified positions.

AMENDED ANALYSIS

This bill establishes the salary for the positions of:

I. Director of community corrections, director of security and training, and the professional standards director in the department of corrections.

II. Chief executive officer, chief pharmacist, and certain pharmacists of the New Hampshire hospital in the department of health and human services.

III. Executive director of the lottery commission.

IV. Director of finance and director of policy and administration in the department of transportation.

This bill is a request of the joint committee on employee classification established under RSA 14:14-c.

AN ACT relative to the salaries of certain unclassified positions.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Compensation of Certain State Officials; Salaries Established. Amend RSA 94:1-a, I(b) by inserting the following position:

GG Department of corrections director of community corrections

2 Compensation of Certain State Officers; Salaries Established. Amend RSA 94:1-a, I(b) by inserting the following position:

9 Director of Policy and Administration; Department of Transportation; Salary Determination. Amend RSA 21-L:5-b, III to read as follows:

III. The position of the director of policy and administration shall be unclassified. The salary of the director shall be [determined after assessment and review of the appropriate temporary letter grade allocation for the position for inclusion] as specified in RSA 94:1-a, I(b)[, which shall be conducted pursuant to RSA 94:1-d and RSA 14:14-c].

10 Funding. The sums necessary to fund the salaries, benefits, or any other costs related to the position changes contained in this act for the biennium ending June 30, 2011 shall be paid from existing FY 2010 and FY 2011 appropriations to the respective departments.

11 Effective Date. This act shall take effect July 1, 2010.

HB 1569 FISCAL NOTE

AN ACT relative to the salaries of certain unclassified positions.

FISCAL IMPACT:

      The Department of Corrections states this bill, as amended by the Senate (Amendment #2010-1336s), will decrease state general fund expenditures by $21,392 in FY 2011, $15,776 in FY 2012, $8,301 in FY 2013 and $8,301 in FY 2014. The Department of Health and Human Services states this bill will increase state expenditures by $100,004 in FY 2011 and each year thereafter. The Lottery Commission states this bill will increase state expenditures by $8,085 in FY 2011 and each year thereafter. The Department of Transportation states this bill will increase state highway fund expenditures by $26,759 in FY 2011 and each year thereafter. There is no fiscal impact on county and local expenditures or state, county and local revenue.

      This bill states any costs associated with the position changes for FY 2010 and FY 2011 shall be paid for from existing appropriations.

METHODOLOGY:

    The Department of Corrections states this bill establishes in RSA 94:1-a, I (b) the salaries for the following positions within the Department of Corrections: director of community corrections, director of security and training, and professional standards director; and the following positions within the Department of Health and Human Services: chief executive officer, chief pharmacist, and six pharmacist positions. The Department states all the Department of Correction positions were funded in the FY 2010-2011. The Department budgeted the salary for both the professional standards director and director of security and training at labor grade GG, step 3 for FY 2010 and labor grade GG, step 4 for FY 2011. The Department assumes for comparative purposes the salary budgeted in FY 2011 will remain constant for FY 2012 through FY 2014. The table below shows the change in expenditures for the professional standards director and director of security and training positions:

    The Director of Community Corrections position was funded using the $100,951 salary included in the FY 2010-2011 budget for the Lakes Region Facility warden position. The Director of Community Corrections salary is $90,606 (labor grade GG, maximum). The difference in the salary for the two positions is $10,345 for FY 2010 through FY 2014. In addition, benefit expenditures will decrease by approximately $217 for FY 2010 through FY 2014 due to the warden position being budgeted as a group II member for benefits and the Director of Community Corrections is a group I member. The total decrease in expenditures is $10,562 in FY 2011 through FY 2014 between the salary for the Director of Community Corrections and the Lakes Region Facility warden position. The total fiscal impact of establishing the unclassified positions (above table and this section) will decrease state general fund expenditures by $21,392 in FY 2011, $15,776 in FY 2012, $8,301 in FY 2013 and $8,301 in FY 2014.

    The Department of Health and Human Services states the increase in salary for the chief executive officer, chief pharmacist and 6 pharmacists plus additional benefit costs (retirement at 11.05%, social security at 6.2% and Medicare at 1.45%) will increase expenditures by $100,004 of which $70,003 (70%) will be state general fund expenditures in FY 2011 through FY 2014. The Department states unclassified positions are not eligible for hazard pay, shift differential, overtime or holiday pay and deducted these costs when determining the fiscal impact associated with changing the positions from classified to unclassified. The costs are as follows:

    The Lottery Commission states increasing the lottery executive director from a labor grade GG, maximum to a labor grade HH, maximum, will increase state expenditures by $8,085 in FY 2011 and each year thereafter.

    The Department of Transportation states it will absorb the cost associated with changing the director of finance from a labor grade GG to a labor grade HH and establishing the position of director of policy and administration at a labor grade of GG. The Department estimates the increased cost associated with the changes above plus benefits will be $26,759 in FY 2011 and each year thereafter.

    This bill does not contain an appropriation for the positions. Additionally, this bill requires the impacted agencies to fund any costs associated with the position changes with existing appropriations for the biennium ending June 30, 2011.
