STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to state agency evaluation of contractors.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Department of Administrative Services; Contractor Evaluations. Amend RSA 21-I by inserting after section 22-d the following new section:

21-I:22-e Contractor Evaluations. Any agency that uses a private contractor for a project over $50,000 shall complete an evaluation of the contractor’s performance. The evaluation shall include the agency’s assessment of the quality of the work, the contractor’s ability to complete the work on time and to remain within budget and project specifications, and such additional measurements as may be appropriate based on the nature and scope of the contract. The commissioner shall develop, by rule under RSA 541-A, guidelines for contractor evaluations, including a standard evaluation form, and shall retain the completed evaluations for future reference, if the contractor subsequently bids on another state project.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 1578-FN - FISCAL NOTE

AN ACT relative to state agency evaluation of contractors.

FISCAL IMPACT:

      The Department of Administrative Services states this bill will increase state general fund expenditures by $42,875 in FY 2011. There will be no fiscal impact on state, county, and local revenue or county and local expenditures.

METHODOLOGY:

    The Department of Administrative Services states this bill requires the Department to develop rules and guidelines for contractor evaluations. The Department assumes it will need to hire an additional full time temporary Administrator III position for six months to develop the rules and guidelines required by this bill, and further assumes the position would be established effective July 1, 2010.

    The Department calculated the cost of hiring an additional Administrator III (Rules and Procedures Administrator) for six months in FY 2011 as follows:

    Salary (Labor Grade 31) $28,968

    Social Security (6.2%) $1,796

    Medicare (1.45%) $420

    Retirement (11.05%) $3,201

    Life Insurance $10

    Dental Insurance $482

    Health Insurance $6,833

    Current Expense $450

    In-State Travel $715
