STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT requiring capital budget projects of the university system of New Hampshire to include payment to the state art fund.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Council on the Arts; State Art Fund; University System. Amend RSA 19-A:9 to read as follows:

19-A:9 Art Fund.

I. There is hereby established a non-lapsing art fund consisting of 1/2 of one percent of the first $15,000,000 of the bid contract price of each new building or major addition authorized by the capital budget to be paid from the general fund. As used in this section, “major addition” means any addition which increases by 25 percent or more the square footage of the building to which it is being added. Contracts for the following projects are excluded:

(a) Repairs;

(b) [University system of New Hampshire;

(c)] Those paid for by the highway fund, fish and game fund, or federal funds; and

[(d)] (c) Self-liquidating projects.

II. The commissioner of administrative services shall pay the specified percent to the fund out of the original capital budget appropriation when the governor and council, or, for university system of New Hampshire projects, the university system board of trustees, approve the construction contract. The percent shall be a charge against the bond or note financing the construction.

III. In the case of university system of New Hampshire projects, the bid contract price shall be that portion of the contract price funded from the state general fund.

2 Effective Date. This act shall take effect July 1, 2010.

HB 1589-FN - FISCAL NOTE

AN ACT requiring capital budget projects of the university system of New Hampshire to include payment to the state art fund.

FISCAL IMPACT:

    The University System of New Hampshire and Department of Administrative Services state this bill will increase state revenue and expenditures by an indeterminable amount in FY 2011 and each fiscal year thereafter. This bill will have no fiscal impact on county and local revenues and expenditures.

METHODOLOGY:

    The University System of New Hampshire (USNH) and Department of Administrative Services state this bill removes an exception for USNH for payment to the state art fund for new buildings or major additions authorized in the capital budget. USNH states that under the Knowledge Economy Education Plan (KEEP-NH), USNH currently receives state capital appropriation funds of $35 million per biennium. On average, one large construction project has been completed each year under this plan over the past few years. One half of one percent of the $15 million threshold under this bill equates to a $75,000. Therefore, state expenditures will increase by the number and amount of projects that exceed the $15 million threshold (or shift from funds previously used for construction) at USNH, and increase state revenue that is deposited into the art fund.
