STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to state aid for wastewater and public water supply projects.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Wastewater and Public Water Supply Projects; Priority Given. As new revenue or appropriations become available to fund state aid under RSA 486 or RSA 486-A, the department of environmental services shall give priority on a first-in, first-out basis to communities that had wastewater projects eligible under RSA 486 or public water supply projects eligible under RSA 486-A that were not funded in fiscal year 2009, fiscal year 2010, or fiscal year 2011.

2 Effective Date. This act shall take effect upon its passage.

HB 1606-FN - FISCAL NOTE

AN ACT relative to the transfer of funds within the department of environmental services.

FISCAL IMPACT:

      The Department of Environmental Services states this bill will increase local revenue by $2,593,763 in FY 2010 and by $1,489,704 in FY 2011 and each year thereafter and increase state general fund expenditures by $1,489,704 in FY 2012 and each year thereafter. There is no fiscal impact on state and county revenue or county and local expenditures.

METHODOLOGY:

    The Department of Environmental Services states this bill requires the commissioner transfer funds of $2,593,763 in FY 2010 and $1,489,704 in FY 2011 already appropriated to the Department to the state aid grants program and drinking water filtration/ interconnection state aid grants. The Department states though the bill allows the commissioner to take funds from any funding source that due to restrictions with federal grants and other funds, such as program fees, the Department is limited to using state general funds. The Department states it will need to layoff approximately 100 of the 136 filled general funded positions by either late in FY 2010 or early in FY 2011 to have sufficient funds to meet the $4,083,867 transfer requirement to state aid programs. The Department states the average personnel cost (salary and benefits) is approximately $75,000 and the average cost associated with a laid off position in the first year of lay off is approximately $34,000, for a net savings of $41,000 ($75,000-$34,000).

    The Department states long-term state aid grant commitments tied to the state revolving loan fund loans are typically 5 to 20 years. By increasing the number of projects funded in FY 2010 and FY 2011 through the transfer, the Department assumes state expenditures will increase by $1,489,704 in FY 2012 and each year thereafter to meet the long term state aid commitments associated with the increased number of projects.

    Local governments that have constructed or will construct eligible water supply and wastewater improvement projects will be eligible for the increased state aid. Local revenue will increase by $2,593,763 in FY 2010 and by $1,489,704 in FY 2011 and each year thereafter.
