STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT directing the commissioner of the department of health and human services to adopt rules regarding transfers of income to special needs trusts.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Pooled Special Needs Trusts; Rulemaking Added. Amend RSA 167:3-c by inserting after paragraph XIV the following new paragraph:

XV. Allowable transfers of income by a Medicaid applicant or recipient to a special needs trust for the purpose of qualifying for services under a home and community-based care waiver as categorically needy, rather than medically needy. Such a trust shall be in compliance with the provisions of section 1917(d)(4) of the Social Security Act.

2 Effective Date. This act shall take effect 60 days after its passage.
