STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Ten
AN ACT repealing the authority for the assessment of an administrative penalty for various OHRV and snowmobile violations.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Repeal. The following are repealed:
I. RSA 215-A:19, VII, relative to administrative penalties for OHRV violations.
II. RSA 215-C:34, VII, relative to administrative penalties for snowmobile violations.
2 Effective Date. This act shall take effect January 1, 2011.

HB 1660-FN - FISCAL NOTE
AN ACT repealing the authority for the assessment of an administrative penalty for various OHRV and snowmobile violations.
FISCAL IMPACT:
The Fish & Game Department states this bill will decrease state fish & game fund revenue by an indeterminable amount in FY 2011 and each fiscal year thereafter. There will be no fiscal impact on county and local revenue or state, county, and local expenditures.
METHODOLOGY:
The Fish & Game Department states this bill repeals the administrative penalty associated with certain violations. The Department states that in FY 2009, 19 individuals were assessed the administrative penalty of $200, for total anticipated fish & game fund revenue of $3,800. Eleven individuals paid the penalty, while eight have not. The Department states it has had difficulty collecting the administrative penalty, in particular from out-of-state residents. The Department states it is not able to estimate revenue from the administrative penalty in future fiscal years; however, repealing the administrative penalty will decrease state fish & game fund revenue by an indeterminable amount.
