AN ACT increasing manufacturers’ pesticide registration fees.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Pesticides; Registration Fee Increase. Amend RSA 430:38, III(a)-(c) to read as follows:
(a) For a restricted use pesticide, [$80] $120 per product per year;
(b) For a general use pesticide, other than a specialty/household pesticide, [$80] $120 per product per year;
(c) For a specialty/household pesticide, [$80] $120 per product per year.
2 Effective Date. This act shall take effect July 1, 2010.

HB 232 FISCAL NOTE
AN ACT permitting the pesticide control board to establish pesticide fees.
FISCAL IMPACT:
The Department of Agriculture, Markets and Food states this bill, as amended by the House (Amendment #2010-0105h), will increase state general fund revenue by $392,220 and state restricted revenue by $43,580 in FY 2011 and each year thereafter. There is no fiscal impact on county and local revenue or state, county, and local expenditures.
METHODOLOGY:
The Department of Agriculture, Markets and Food states this bill will increase manufacturers’ pesticide registration fees. The Department registers approximately 10,895 products in three categories. The three categories include restricted use pesticide (414 registrations), general use pesticide (5,216 registrations), and specialty/household pesticide (5,265 registrations). The fees for these registrations would increase by $40 from $80 to $120 for each registration. The Department estimates revenue will increase by $435,800 ($40 * 10,895) each year. RSA 430:50, II requires that 10 percent of the pesticide registration fees collected be deposited into the integrated pest management fund. Of the $435,800 of increased revenue, approximately $43,580 would go to the integrated pest management fund and $392,220 would go to the general fund.
