STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nine
AN ACT relative to the maintenance of state-owned dams.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Dam Maintenance Fund Established. Amend RSA 482:55 to read as follows:
482:55 Fund Established. For the state of New Hampshire to meet its commitments to maintain its dams and impoundments and associated property for future generations and promote the safety of the public, there is established a dam maintenance fund to cover the cost of performing work on state-owned dams and property associated with and contiguous to state-owned dam sites, as well as noncontiguous property, such as rainfall and stream gages, that is essential to the safe operation of the dam. This fund shall be a nonlapsing fund which shall be continually appropriated for the purposes of this section. The treasurer shall deposit all money credited to the fund in an interest-bearing account.
2 New Section; Funding for Maintenance of State-Owned Dams. Amend RSA 482 by inserting after section 56 the following new section:
482:56-a Funding for Maintenance of State-Owned Dams. The legislature shall adequately appropriate funds for the maintenance of state-owned dams. Funding for such maintenance may be from dedicated funds or from bequests to the dam maintenance fund established under RSA 482:55.
3 Effective Date. This act shall take July 1, 2009.

AN ACT relative to the maintenance of state-owned dams.
FISCAL IMPACT:
The Department of Environmental Services states this bill, as amended by the House (Amendment #2009-0314h), will have an indeterminable fiscal impact on state, county, and local revenues and expenditures in FY 2010 and each year thereafter.
METHODOLOGY:
The Department of Environmental services states this bill amends RSA 482 to require the legislature to adequately appropriate funds for the maintenance of state-owned dams. This bill states funding for such maintenance may be from dedicated funds or from bequests to the dam maintenance fund established under RSA 482:55. The Department states due to the lack of detail in this bill, the fiscal impact of this bill on state, county, and local revenues and expenditures is indeterminable in FY 2010 and each year thereafter.
