STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT authorizing revocation and suspension of vehicle dealer licenses.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Revocation or Suspension of Dealer License. Amend RSA 261 by inserting after section 111-a the following new section:

261:111-b Revocation or Suspension of Dealer License. After a hearing and upon a finding that a dealer has violated any provision of this subdivision or rules adopted pursuant to this subdivision, the director may revoke or suspend the dealer’s license for an appropriate period of time considering the severity of the offense, the number of offenses committed, and whether the dealer committed prior offenses. If a license is revoked and the director determines after a hearing that an owner, partner, or officer of the dealer is in violation of any provision of the dealer laws or rules, the department may prohibit the owner, partner, or director from obtaining any form of dealer license for up to 5 years.

2 Effective Date. This act shall take effect January 1, 2011.
