AN ACT relative to legislative study committees.

ANALYSIS

This bill:

I. Revises the statute governing the repeal of statutory authorization for any study committee established by the general court in chapter law during the 2011 legislative session or thereafter.

II. Is a request of the committee to study the list of non-regulatory boards, commissions, councils, advisory committees, and task forces established in 2009, 144:87 (HB 2-FN-A-LOCAL).

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to legislative study committees.

Be it Enacted by the Senate and House of Representatives in General Court convened:

232:1 Legislative Study Committees. Amend RSA 14:49 to read as follows:

14:49 [Sunset Date for] Legislative Study Committees.

I. The statutory authorization for every study committee which is established by the general court shall be repealed [on the date on which the committee is required to file its report. In the event that there is no report date, the statutory authorization for the study committee shall be repealed at 12:01 a.m. on the first Wednesday of December] either upon the filing of a final report or on November 1 in the even-numbered year prior to the beginning of the [legislative] subsequent biennial session, whichever is earlier.

II. [The provisions of paragraph I shall not apply only if:

(a) The general court in a subsequent legislative session specifically extends the effective date upon which the study committee shall complete its duties; or

(b) The study committee has no effective date upon which it shall complete its duties and is specifically authorized to make reports on a continuing basis either annually or more frequently.] In this section, “study committee” shall mean a committee, commission, task force, council, or any other similar entity established by the general court in chapter law to study or otherwise address a specified issue, and shall not include any similar entities that are codified in statute.

232:2 Applicability. The provisions of section 1 of this act shall only apply to study committees established by the general court in chapter law on or after the effective date of this act.

232:3 Effective Date. This act shall take effect upon its passage.
