AN ACT relative to the Masonic Home.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to the Masonic Home.

Be it Enacted by the Senate and House of Representatives in General Court convened:

30:1 Masonic Home; Name Change to New Hampshire MasoniCare. The name of the Masonic Home, which was incorporated by 1883, 194 as the Masonic Orphans’ Home, and amended by 1901, 194 to be named the Masonic Home, is hereby changed to New Hampshire MasoniCare, by which name it shall hereafter be known and transact all the business of the corporation.

30:2 Masonic Home; Powers. Amend 1901, 194:2, as amended by 1929, 323:1 to read as follows:

SECT. 2. Said corporation shall have the right and power to take and hold by purchase, gift, devise, assignment, or otherwise, real and personal estate to an amount not exceeding [nine hundred thousand dollars] $5,000,000; to manage, improve, and invest, and to dispose of and convey the same as the purposes of the corporation shall require. Said corporation is [authorized and] empowered to act as trustee and to receive, hold, manage, and conduct funds and property as such and to apply the same with all the powers, rights, and privileges and subject to all the duties and obligations in a similar manner as provided by law for natural persons. To provide compensation for services provided, New Hampshire MasoniCare is authorized to apply for and receive any and all remuneration due the recipient through federal, state, local, and private insurance, reimbursement programs, assignment of estate private holdings, and any other payments made through gifts, bequests, wills, testaments, and the like, provided all financial management of the holdings of the corporation follows the guidelines for nonprofit organizations described in section 501(c)(3) of the Internal Revenue Code.

30:3 Masonic Home; Object. Amend 1883, 194:3, as amended by 1897, 151:1 and 1909, 214:1 to read as follows:

SECT. 3. The object of [this institution] New Hampshire MasoniCare shall be to provide [and sustain a home for destitute Freemasons and destitute widows and orphans of] care to the Freemasons of the State of New Hampshire, [and also for the destitute wives of inmates of said home, provided said wives are over sixty-five years of age, residents of the State of New Hampshire, and] their wives and widows, provided said wives and widows have been married to and lived with their said husbands for at least ten years [next] prior to the [admission of said husbands to said home] initial request for care. Care may be provided in either a residential facility or the recipient’s private home, or by providing resources to the recipient which may include medical care, housekeeping assistance, medical equipment, drug therapy, end-of-life care, or any other gerontological care deemed appropriate by the board of trustees of the corporation. Such care may also be extended to recipients from without the Masonic Fraternity by act of the board of trustees.

30:4 Masonic Home; Officers. Amend 1883, 194:4, as amended by 1935, 274:1 and 1941, 271:1 to read as follows:

SECT. 4. The officers of this corporation shall be a president, a vice-president, a clerk, a treasurer, with such duties respectively as usually attach to those offices, and a board of sixteen trustees, [four] nine of whom shall be [the Grand Master, the Deputy Grand Master, the Senior Grand Warden and the Junior Grand Warden of the Grand Lodge of Free Masons ex officio. The Grand Master of the Grand Lodge of Free Masons shall be president ex officio of the corporation. Twelve] Freemasons in good standing of a regular Masonic Lodge in the state of New Hampshire. The members of the board of trustees shall be elected by the corporation, and shall hold their offices for such time as may be provided for in the bylaws. The board of trustees shall have the management and control of all the affairs of the corporation and shall have and be vested with all its powers, and shall operate through the provisions of its president, who will act as the executive officer. The president of the corporation, appointed by the board, shall be a compensated professional and a regular full-time employee of the corporation, who shall have all the executive powers and rights with which to make operating decisions in the best interests of the corporation. [They] The board shall elect annually a chairman, who shall be also the vice-president of the corporation, a clerk, who shall be also the clerk of the corporation, and be sworn to the faithful discharge of his or her duty, and a treasurer of the corporation, who shall give bond with sufficient sureties to the satisfaction of the board[; and]. All of said elective officers shall continue in office until their successors are chosen and qualified. In case of vacancy, said trustees may at any meeting fill the same[, and no officer named in this section shall receive any salary or compensation for any service or duty he may perform].

30:5 Repeal. 1883, 194:5, relative to destitute children of deceased Free Masons, is repealed.

30:6 Effective Date. This act shall take effect upon its passage.
