AN ACT relative to division responsibility for road toll administration, hazardous waste transport, truck weight enforcement, and the international registration plan by the department of safety and relative to clerical support for the advisory board of fire control.

ANALYSIS

This bill:

I. Transfers responsibility for road toll administration and enforcement of the fuel tax agreement from the division of motor vehicles to the division of administration and makes the division of administration responsible for the international registration plan.

II. Transfers the position of road toll administrator from the division of motor vehicles to the division of administration.

III. Transfers responsibility for hazardous waste transport and truck weight enforcement from the division of motor vehicles to the division of state police.

IV. Directs the division of fire safety, rather than the division of administration, to provide clerical support to the advisory board of fire control.

This bill is a request of the department of safety.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to division responsibility for road toll administration, hazardous waste transport, truck weight enforcement, and the international registration plan by the department of safety and relative to clerical support for the advisory board of fire control.

Be it Enacted by the Senate and House of Representatives in General Court convened:

11:1 New Paragraphs; Department of Safety; Division of Administration; Responsibility for Road Toll Administration, Fuel Tax Agreement, and International Registration Plan; Appointment of Road Toll Administrator. Amend RSA 21-P:6 by inserting after paragraph VII the following new paragraphs:

VIII. Collection of fuel taxes and administration of road tolls, the international fuel tax agreement, and the international registration plan under RSA 260.

IX. Appointment, with the approval of the commissioner, of a road toll administrator who shall be a classified employee and who shall, under the supervision of the director of administration, be responsible for administration of the motor vehicle road toll law and the fuel tax agreement. The director of administration may delegate to the administrator authority to sign and execute any documents pertaining to the director’s work and such documents so signed by the road toll administrator shall have the same effect as though signed by the director.

11:2 Division of State Police; Responsibility for Hazardous Waste Transport and Truck Weight Enforcement. Amend RSA 21-P:7, I(a) to read as follows:

(a) Enforcing state criminal[,] and motor vehicle[, hazardous waste, and other] laws, public safety laws, and laws relative to hazardous waste, hazardous materials transportation, and truck weight enforcement.

11:3 Division of Motor Vehicles; Scope of Responsibility. RSA 21-P:8, III is repealed and reenacted to read as follows:

III. Administration of the motor vehicle laws under RSA 260, except for road toll administration under RSA 260:30 through RSA 260:65-a, the fuel tax agreement under RSA 260:65-b through RSA 260:65-e, and the international registration plan under RSA 260:73 through RSA 260:75, which shall be administered by the division of administration.

11:4 Division of Motor Vehicles; Financial Responsibility Administrator. Amend RSA 21-P:9 to read as follows:

21-P:9 Assistant to the Director; [Road Toll Administrator;] Financial Responsibility Supervisor. The director of motor vehicles, with the approval of the commissioner, shall appoint the following assistants, who shall be classified employees:

I. An assistant to the director of motor vehicles, who shall carry out such duties as may be assigned to him or her by the director.

II. [A road toll administrator who shall assume, under the control of the director of motor vehicles, the responsibility of the administration of the motor vehicle road toll law. The director may delegate to said administrator authority to sign and execute any documents pertaining to his work and such documents so signed by the administrator shall have the same effect as though signed by the director.

III.] A financial responsibility supervisor who shall assume, under the control of the director of motor vehicles, the responsibility of the administration of the motor vehicle financial responsibility law. The director may delegate to said supervisor authority to sign and execute any documents pertaining to his or her work and such documents so signed by the supervisor shall have the same effect as though signed by the director.

11:5 New Paragraph; Division of Fire Safety; Clerical Support for Advisory Board of Fire Control. Amend RSA 21-P:12 by inserting after paragraph VII the following new paragraph:

VIII. Provision of clerical support for the state advisory board of fire control.

11:6 Repeal.

I. RSA 21-P:6, VI, relative to clerical support for the advisory board of fire control by the division of administration.

II. RSA 21-P:8, IV relative to hazardous materials transportation and truck weight enforcement by the division of motor vehicles.

11:7 Effective Date. This act shall take effect upon its passage.
