AN ACT relative to workers’ compensation for illegal aliens.

ANALYSIS

This bill limits payments under workers’ compensation law to medical, hospital, and remedial payments in the case of any illegal alien injured in the course of employment.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to workers’ compensation for illegal aliens.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Medical Payments; Illegal Aliens. Amend RSA 281-A by inserting after section 23-b the following new section:

281-A:23-c An employer subject to this chapter, or the employer’s insurance carrier, shall be responsible for an illegal alien’s medical, hospital, and remedial care if the employer knew or should have known that the employee was an illegal alien and the illegal alien suffers an injury arising out of the course of employment. The illegal alien shall not be entitled to indemnity payments under this chapter.

2 Effective Date. This act shall take effect January 1, 2012.
