STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to the deposit of fees collected under the Unified Carrier Registration System into the highway fund.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Duties of Commissioner; Deposit of Fees. Amend RSA 21-P:4, XIV(d) to read as follows:

(d) To adopt rules, under RSA 541-A, as are necessary for the proper administration and enforcement of this paragraph. Such rules may include, without limitation, rules establishing registration fees and other fees sufficient to cover the direct and indirect costs of administration and enforcement of this section. All fees collected under this section shall be deposited into the [general fund] highway fund to promote motor carrier safety programs and enforcement, and to administer costs associated with the administration of the Unified Carrier Registration System.

2 Effective Date. This act shall take effect July 1, 2011.

HB 277 FISCAL NOTE

AN ACT relative to the deposit of fees collected under the Unified Carrier Registration System into the highway fund.

FISCAL IMPACT:

      The Department of Safety states this bill will decrease State general fund and increase State highway fund revenue by $1,320,000 in FY 2012 and each year thereafter. The Department also states this bill will increase State highway fund expenditures and local revenue by $158,400 in FY 2013 and each year thereafter. There is no fiscal impact on county revenue or county and local expenditures.

METHODOLOGY:

    The Department of Safety states this bill will change the deposit location for fees collected under the Unified Carrier Registration System from the State general fund to the State highway fund. The bill requires the fees be used to promote motor carrier safety programs and enforcement, and administrative costs associated with the administration of the Unified Carrier Registration System.

    The Department estimates revenues for 2012 and each year thereafter will be $1,320,000 based on estimated revenue for FY 2011. The Department also states RSA 235:23 requires 12% of highway fund revenue from the previous year be allocated to local governments through the local highway aid fund, resulting in a 12%, or $158,400, increase in State highway fund expenditures and local revenue beginning in FY 2013.
