STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to payment for election services to unincorporated places.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Services to Unincorporated Places. Amend RSA 668:8 to read as follows:

668:8 Service to Unincorporated Places.

I. For services to unincorporated places during any state general election as directed by this chapter, the town clerk of the town designated pursuant to RSA 668:2 shall be paid the sum of $50. Said payment shall be a charge against the appropriation for elections for the office of secretary of state.

II. If an unincorporated place exceeds 10 voters, and has not organized pursuant to RSA 53:1, the county in which the unincorporated place is located shall pay the town designated pursuant to RSA 668:2 for costs it incurs in conducting a primary or general election for the unincorporated place. The county shall assess the cost of conducting an election under this paragraph to the unincorporated place.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 288 FISCAL NOTE

AN ACT relative to payment for election services to unincorporated places.

FISCAL IMPACT:

      The New Hampshire Municipal Association states this bill may increase local revenue and expenditures by an indeterminable amount in FY 2011 and each year thereafter. There is no fiscal impact on state and county revenue or expenditures.

METHODOLOGY:

    The New Hampshire Municipal Association states this bill provides that if an unincorporated place is not organized for voting, the Secretary of State shall designate a town in the same representative district where persons domiciled in the unincorporated place may register and vote. For those services, the town clerk is paid $50 by the state. This bill would require the county to pay the town for costs incurred in conducting a primary or general election for the unincorporated place. The bill allows for the county to assess the cost of conducting the election to the unincorporated place, which may increase the unincorporated place costs. The Association states this may result in an increase in revenue to the towns but the Association has no data available to determine an exact fiscal impact.

    The Secretary of State states this bill will have no fiscal impact on the Department because it already prepares election and voting materials for unincorporated places.

    The New Hampshire Association of Counties states this bill will have no fiscal impact on county expenditures. The county would be able to assess any costs paid to a town for running an election for an unincorporated place to the unincorporated place.
