STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT requiring parental consent for court referral of a minor to a juvenile diversion program.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Delinquent Children; Juvenile Diversion Program; Parental Consent. Amend RSA 169-B:10, III(c) to read as follows:

(c) The minor and the parents, guardian, or other custodian give knowing, informed, and voluntary consent [with the knowledge that consent is not obligatory].

2 Children in Need of Services; Diversion Program; Parental Consent. Amend RSA 169-D:9, III(c) to read as follows:

(c) The child and parent, guardian or other custodian give knowing, informed, and voluntary consent [with the knowledge that consent is not obligatory].

3 Effective Date. This act shall take effect January 1, 2012.
