STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT reducing the fee for copies of birth certificates.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Fees for Copies, Verifications, and Amendments to Vital Records. Amend RSA 5-C:10, I-II to read as follows:

I. A town clerk or the registrar shall be paid in advance, by any person requesting any copy or verification as provided in RSA 5-C:9, the sum of [$15] $12 for making a search, which sum shall include payment for the issuance of such copy or verification, and [$10] $8 for each subsequent copy, provided that the fee to town clerks for examination of documents and issuance of a delayed birth certificate shall be $25.

II. The town clerk shall forward $8 of each search fee collected by the clerk under this section to the department of state for deposit in the vital records improvement fund established under RSA 5-C:15[, and $3 to the state treasurer for deposit in the general fund,] and shall retain the remaining $4 as the clerk’s fee for issuing such a copy. For subsequent copies issued at the same time, the town clerk shall forward $5 of the fee collected for each subsequent copy under this section to the department for deposit in the vital records improvement fund established under RSA 5-C:15 [and $2 to the state treasurer for deposit in the general fund,] and the town clerk shall retain the remaining $3 as the clerk’s fee for issuing such a copy. The town clerk shall retain the $25 fee for a delayed birth certificate as the clerk’s fee for examining documents and issuing the delayed birth certificate. Fees collected by the registrar shall be forwarded to the state treasurer for deposit into the vital records improvement fund established under RSA 5-C:15.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 36-FN-LOCAL - FISCAL NOTE

AN ACT reducing the fee for copies of birth certificates.

FISCAL IMPACT:

      The Secretary of State states this bill will decrease state revenue by $350,000 in FY 2012 and each year thereafter. There will be no fiscal impact on state expenditures or local and county revenue and expenditures.

METHODOLOGY:

    The Secretary of State states this bill will repeal the fee increase for searches and copies of vital records enacted in 2010, by eliminating the portion of the fee designated for the general fund. This bill reduces the fee of a vital record search by $3.00, resulting in lost revenue of $222,000 per year from an estimated 74,000 vital records searches. This bill also reduces the fee for a vital record copy by $2.00, resulting in lost revenue of $128,000 from an estimated 64,000 vital records copies.

    The New Hampshire Municipal Association states there will be no fiscal impact on local revenue or expenditures.
