STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT requiring daily physical education for public school pupils.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 School Boards; Studies. Amend RSA 189:10 to read as follows:

189:10 Studies. The school board shall ensure that health education and physical education are taught to pupils as part of the basic curriculum. The school board shall ensure that a minimum of 45 minutes of daily physical education, or recess, or both, is provided to pupils in grades one through 8, and to pupils enrolled in a full-day kindergarten program, in increments of not less than 20 minutes. The school board shall ensure that all studies prescribed by the state board of education are thoroughly taught, especially physiology, hygiene, and health and physical education as they relate to the effects of alcohol and other drugs, child abuse, human immunodeficiency virus (HIV)/acquired immunodeficiency syndrome (AIDS), and sexually transmitted diseases on the human system.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 377 FISCAL NOTE

AN ACT requiring daily physical education for public school pupils.

FISCAL IMPACT:

      The Department of Education and the New Hampshire Municipal Association state this bill will increase local expenditures by an indeterminable amount in FY 2012 and each year thereafter. There will be no fiscal impact on state, county, and local revenues or state and county expenditures.

METHODOLOGY:

    This bill requires a minimum of 45 minutes of daily physical education, or recess, or both to be provided to pupils in grades one through eight and to all pupils enrolled in a full-day kindergarten program. The Department of Education states the proposed legislation creates an increase in local expenditures that would vary from school district to school district and is therefore indeterminable. The Department notes students in grades K through 4 typically receive 30 to 40 minutes of recess daily and to increase this time by 5 to 15 minutes would have a minimal fiscal impact if any. However, the department notes that students in grades 5 through 8 may or may not receive daily recess and may or may not receive physical education on a regular, weekly basis thus creating a greater fiscal impact. The Department notes that in order to determine the fiscal impact on a particular school, staff, resources, and facilities need to be analyzed. The Department notes potential costs at the local level could include increases in physical education staff or an increase in teaching load, the availability of facilities that are appropriate for the safe delivery of physical education, and increases in supplies and equipment necessary for the effective delivery of physical education programs.

    The New Hampshire Municipal Association states the proposed legislation could conceivably result in some increased costs for school districts but notes there would be no fiscal impact on most municipalities.
