STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to distributing campaign materials at the polling place.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Distributing Campaign Materials at Polling Place. Amend RSA 659:43, II to read as follows:

II. No person who is a candidate for office or who is representing or working for a candidate shall distribute any campaign materials or perform any electioneering activities or any activity which affects the safety, welfare, and rights of voters within a corridor [10] 15 feet wide and extending [a distance] from the entrance door of the building [as determined by the moderator] where the election is being held to the nearest public way or parking area. In cities and towns that have not adopted an ordinance establishing the dimensions of the corridor, the moderator may, in the interests of the safety, welfare, and rights of voters, alter the dimensions of the corridor, if the moderator posts notice of the altered dimensions at the office of the town or city clerk or at the town hall at least 10 days before the election. The altered dimensions shall be subject to review by the secretary of state, if such review is requested by a resident of the town or ward or candidate appearing on the ballot in the town or ward at least 3 days before the election; following the review, the secretary of state shall either approve or modify the altered dimensions of the corridor. If, due to an unforeseen event, enforcement of the dimensions of the corridor would endanger public safety, the moderator may establish temporary emergency dimensions until the danger to public safety has passed; the moderator shall promptly notify the secretary of state of the circumstances requiring the establishment of temporary emergency dimensions.

2 Effective Date. This act shall take effect January 1, 2012.
