STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to the exhumation and testing of victims of the so-called Connecticut River Killer and making an appropriation therefor.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Appropriation; Cold Case Homicide Unit. The sum of $200,000 for the fiscal year ending June 30, 2012 is hereby appropriated to the cold case homicide unit established in 2009; 269 for the purpose of petitioning a court of competent jurisdiction for an order to exhume the victims of the so-called Connecticut River Killer and to perform DNA testing on such victims to identify any evidence that may link the killings to the Connecticut River Killer. The cold case homicide unit shall obtain approval from the family of each victim prior to proceeding under this section. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

2 Effective Date. This act shall take effect July 1, 2011.

HB 433-FN-A - FISCAL NOTE

AN ACT relative to the exhumation and testing of victims of the so-called Connecticut River Killer and making an appropriation therefor.

FISCAL IMPACT:

      The Department of Justice and the Department of Safety state this bill will increase state general fund expenditures by $200,000 in FY 2012. There will be no fiscal impact on state, county, and local revenue or county and local expenditures.

      This bill appropriates $200,000 in FY 2012 from the general fund to the Department of Safety for the purposes of this act.

METHODOLOGY:

    This bill appropriates $200,000 to the cold case homicide unit for the exhumation and DNA testing of the victims of the so-called Connecticut River Killer. The Department of Justice states although the proposed legislation appropriates $200,000 for the purposes stated above, they are unable to determine the actual costs of exhuming the bodies of the victims and the subsequent DNA testing. The Department notes it would be necessary to research the circumstances of each individual’s burial to determine the likelihood that remains still exist and are in a condition that lends itself to DNA testing or what types of DNA testing could be done. The Department also notes the cost of the DNA testing would be dependent upon what types of testing could be done and that the costs of exhumation itself are unknown.

    The Department of Safety states due to the passage of time and subsequent degradation of the bodies, most of the DNA testing would need to be outsourced. However, the Department believes the amount of the appropriation is adequate given the number of victims that would be required to be exhumed and subjected to DNA testing.
