STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to the commemoration of General John Stark Day.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Observances Proclaimed by the Governor; General John Stark Day. Amend RSA 4:13-l to read as follows:

4:13-l General John Stark Day. The governor shall annually proclaim the fourth Monday in April as General John Stark Day [and shall urge cities and towns throughout the state to observe this day] in commemoration of General Stark’s gallant and illustrious service to New Hampshire and his country. Schools are encouraged to commemorate the day with appropriate educational activities.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 444-FN - FISCAL NOTE

AN ACT relative to the commemoration of General John Stark Day.

FISCAL IMPACT:

      The Department of Administrative Services, the New Hampshire Association of Counties, and the New Hampshire Municipal Association state this bill, as amended by the House (Amendment #2011-0590h), may increase state, county, and local expenditures by an indeterminable amount in FY 2012 and each fiscal year thereafter. There will be no fiscal impact on state, county and local revenues.

METHODOLOGY:

    The Department of Administrative Services states this bill establishes John Stark Day as a state holiday. The Department states this bill’s fiscal impact will depend on whether or not it results in a state holiday for state offices and employees, which is determined through collective bargaining. The Department states if, through collective bargaining, it does result in an additional state holiday for employees it would result in additional overtime and holiday pay for personnel. The Department it is unable to estimate the additional overtime and holiday pay costs as a result of an additional state holiday in FY 2012 and each fiscal year thereafter, however does state the total overtime and holiday pay paid to state employees for Veterans Day in 2010 was $455,479.

    The New Hampshire Association of Counties states this bill establishes an additional state holiday and since many county employees work at locations that do not close, such as county nursing homes and correctional facilities, there could be increased personnel related expenditures for holiday and overtime pay, for which the Association is unable to estimate.

    The New Hampshire Municipal Association states this bill adds a new state holiday which could result in an increase to local expenditures related to overtime and holiday pay for 24 hour per day, seven days per week employees, such as law enforcement or fire and rescue. The Association is unable to estimate this bill’s impact to local expenditures at this time.
