STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to a certain E-Z Pass discount for Nashua toll plazas.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Toll Criteria. Amend RSA 237:11, V to read as follows:

V. Notwithstanding any other provision of law to the contrary, the discount on the established tolls on any of the turnpikes in the system for vehicles using the regional electronic toll collection system shall be 30 percent for passenger vehicles, including motorcycles, and 10 percent for commercial vehicles, except that the discount on the established tolls at any toll plaza in Nashua shall be 50 percent for passenger vehicles, including motorcycles, registered within the 03060, 03063, and 03054 zip codes. The commissioner of the department of transportation shall adopt rules pursuant to RSA 541-A relative to identification of vehicles eligible for such discount.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 472 FISCAL NOTE

AN ACT relative to a certain E-Z Pass discount for Nashua toll plazas.

FISCAL IMPACT:

      The Department of Transportation states this bill may have an indeterminable fiscal impact on state turnpike fund revenue in FY 2012 and each year thereafter. There will be no fiscal impact on county and local revenues or state, county, and local expenditures.

METHODOLOGY:

    This bill establishes a 50% discount at any Nashua toll plaza for residents within certain zip codes. The Department of Transportation states presently toll plazas do not exist in Nashua, toll rates are not established for Nashua, and traffic varies along the various segments of the F.E. Everett Turnpike through Nashua. The Department notes the fiscal impact from a 50% discount for vehicles registered within certain zip codes for travel through an intangible toll plaza is indeterminable. However, given the current toll rates, in the event a toll plaza were to be constructed in Nashua between exits 1 and 2 with toll plazas placed on the on and off ramps of exits 1 and 2, and E-Z Pass account holders in zip codes 03060, 03063, and 03054 were to be issued a 50% discount instead of a 30% discount, state turnpike fund revenues would be decreased by approximately $226,136 per fiscal year.
